Are Your Policies Updated for HOTMA?

HUD’s Office of Multifamily Housing Programs (MFH) issued Notice H 2024-04 on February 28, 2024, extending the deadline for owners of Project-Based Rental Assistance (PBRA) properties to update their Tenant Selection Plans (TSPs) to May 31, 2024 (from March 31). 

Revised TSPs should reflect the “Housing Opportunity Through Modernization Act of 2016” (HOTMA) rules and discretionary policies. These changes are vital to ensure the property complies with HUD’s standards and requirements.  US Housing Consultants is ready to assist you in achieving compliance. 

The notice compels owners to develop a TSP  and make it public, providing, in writing, the owner’s tenant selection policies and procedures, which include descriptions of eligibility requirements and income limits for admission to a PBRA property. A TSP must include information regarding whether a property is restricted to occupancy by elderly people or whether there are preferences for certain other tenant characteristics. The restriction or preference must cite supporting documentation to ensure nondiscrimination in the selection of tenants.

Updating Your EIV Policy

With HOTMA, many things are changing about EIV, including when you need to run reports and the use of self-certification of income. These changes also provide new flexibility with income determination, which can ultimately make the process less burdensome for residents.  Of course, like everything related to managing HUD properties, owners and agents need to have a solid plan to show how they are handling EIV reports and give their team members clear instructions on when to run reports and why.
